Abstract
A discussion of the intentional deprivation of life of terrorist suspects in a counterterrorism context. Three three case studies involving the killing of individual terrorist suspects are examined: the extrajudicial killings of IRA terrorists in Gibraltar in 1988, Jean Charles Menezes in London in 2005, and Reyaad Khan in Syria in 2015. In this context, the escalation of State responses to terrorism, the individualising of terrorist threats, and the subordination of human rights law through arguments justifying the prioritisation of security over the right to life of individual terrorist suspects, demonstrates the inability of HRL to recognise and protect the inherent dignity and right to life of suspected persons in the counterterrorism context.
